These Terms of Service ("Terms") govern your access to and use of the Luminéa website and your purchase of products from our online store. Luminéa is operated by the holder of ABN 82 473 261 070 ("we", "us", "our"). By accessing our website or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years of age, or have the consent and supervision of a parent or guardian, to purchase from our store. By placing an order you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.

Products and Descriptions

We take care to describe and display our products accurately. However, product images are for illustration and colours may vary depending on your device screen. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

Not a Medical Device

Luminéa Lift™ is a beauty and wellness device. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition. It uses LED light, gentle warmth and micro-vibration to support the appearance of firmer, smoother-looking skin as part of a regular skincare routine. Individual results vary. If you are pregnant, have a medical condition, an implanted device, or sensitive or broken skin, please consult your physician before use, and always follow the instructions provided with the product.

Pricing and Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Payment is required in full at the time of order. We reserve the right to refuse or cancel any order, including where a product has been listed at an incorrect price or where we suspect fraudulent or unauthorised activity. Where we cancel an order for which you have already paid, we will refund the amount paid.

Orders and Acceptance

Your order is an offer to purchase. Acceptance occurs when we dispatch the goods to you. If we are unable to fulfil your order, we will contact you and arrange a refund of any amount paid.

Shipping and Returns

Delivery of orders is governed by our Shipping Policy, and returns and refunds are governed by our Refund & Returns Policy. Both form part of these Terms.

Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by law, and subject to the consumer guarantees above, our liability for any claim arising from your use of our website or products is limited, at our option, to resupplying the relevant goods or paying the cost of having the goods resupplied. We are not liable for any indirect or consequential loss to the extent that such exclusion is permitted by law.

Intellectual Property

All content on this website, including the Luminéa name, logo, product names, text, images and design, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce or use this content without our prior written permission.

Acceptable Use

You agree not to use our website for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to any part of the site or its systems.

Governing Law

These Terms are governed by the laws of the State of Queensland and the Commonwealth of Australia. Any dispute arising under these Terms is subject to the non-exclusive jurisdiction of the courts of Queensland.
